Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Revigard platform, website, and services (collectively, the “Service”) provided by BEJEWEAR OÜ (“Company”, “we”, “us”, or “our”), a company registered in Estonia. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Revigard is an AI-powered reputation management platform that helps businesses monitor, analyze, and respond to customer reviews. The Service may include, but is not limited to:

• Automated collection and aggregation of online reviews from third-party platforms
• AI-generated response suggestions and automated reply capabilities
• Revenue impact analysis and risk scoring
• Reputation analytics and reporting dashboards
• Web push notifications and real-time alerts

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Account Registration & Security

To use the Service, you must register for an account and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity. Account access is subject to administrator approval at our discretion.

4. Subscription Plans & Billing

4.1 Free Trial

We may offer a free trial period. At the end of the trial, your account will be converted to a paid subscription unless you cancel before the trial expires. No credit card is required during the trial period.

4.2 Paid Subscriptions

Paid plans are billed on a monthly or annual basis as indicated at the time of purchase. All fees are exclusive of applicable taxes unless stated otherwise. Payment processing is handled by our third-party payment provider (Creem.io). By subscribing, you also agree to Creem’s terms of service.

4.3 Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe you are entitled to a refund, please contact us at support@revigard.com.

4.4 Price Changes

We reserve the right to change our pricing at any time. Existing subscribers will be given at least 30 days’ notice before any price increase takes effect on their next billing cycle.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Post, transmit, or generate fake, fraudulent, or misleading reviews or responses
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to harass, abuse, or harm another person or entity
• Scrape, data mine, or use automated means to access the Service beyond what is provided by the API
• Resell, sublicense, or redistribute the Service without prior written consent
• Interfere with or disrupt the integrity or performance of the Service

Violation of these rules may result in immediate suspension or termination of your account without refund.

6. Intellectual Property

The Service, including all software, design, text, graphics, logos, and other content, is the exclusive property of BEJEWEAR OÜ and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your subscription period.

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to process, store, and display your data solely to provide and improve the Service.

7. AI-Generated Content & No Guarantee of Results

The Service uses artificial intelligence to generate review response suggestions and analytics. You acknowledge and agree that:

• AI-generated content is provided as suggestions and should be reviewed before publication
• You are solely responsible for any content you choose to publish using the Service
• We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated responses
• AI outputs may occasionally contain errors, and you should exercise your own judgment
• We do not guarantee any specific business results, including but not limited to increased revenue, improved ratings, higher customer engagement, or any other outcome
• The Service is a tool to assist your reputation management — actual results depend on many factors outside our control, including the quality of your products and services, market conditions, and customer behavior
• Any case studies, examples, or projections shown on our website or marketing materials are illustrative only and do not constitute a promise of similar results

8. Third-Party Integrations

The Service may integrate with third-party platforms (e.g., Google Business Profile). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

9. Data Protection & Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to compliance with the EU General Data Protection Regulation (GDPR) and other applicable data protection laws.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL PRODUCE ANY PARTICULAR BUSINESS RESULT, INCREASE YOUR REVENUE, IMPROVE YOUR RATINGS, OR ACHIEVE ANY OTHER SPECIFIC OUTCOME.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless BEJEWEAR OÜ, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings or by contacting support. We may suspend or terminate your access to the Service immediately if:

• You breach any provision of these Terms
• Your account is inactive for an extended period
• We are required to do so by law
• We discontinue the Service

Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or legitimate business purposes, after which it will be securely deleted.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through the courts of Tallinn, Estonia, unless otherwise required by applicable consumer protection laws in your jurisdiction.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify registered users of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between you and BEJEWEAR OÜ regarding the use of the Service and supersede all prior agreements and understandings.
